I Have Not Been Summoned For Interrogation - Ben Muna

Barrister Ben Muna, leader of a faction of the Social Democratic Front, SDF, has refuted reports that a Yaounde State Counsel has summoned him for interrogation over the murder, on May 26, 2006, of Gregoire Diboulé.

Diboulé was found dead in front of the Prestige Hotel in Yaounde after a clash between the Fru Ndi and Ngwasiri camps of the SDF, over a controversial convention of the party that was convened by the latter in Yaounde. After interrogating SDF Chairman, Fru Ndi, on the matter, talk was rife in Yaounde that the State Counsel would this time around, grill Ben Muna.

There were claims that the snail pace of the case is because the group headed by Ben Muna is refusing to cooperate with the legal department. Besides, press reports claim that he (Ben Muna) was eventually summoned for interrogation.

But when The Post visited the premises of the Yaounde Legal Department on October 25, only Barrister Emmanuel Tchokongoe, one of the lawyers of the Fru Ndi's SDF was there. He said he was at the legal department to see if the allegation on the interrogation of Ben Muna was true.

Tchokongoe disclosed that the information he got from the registrar was that the legal department has been waiting since October 24 for Ben Muna who failed to show up. Asked whether Ben Muna was actually served a summons to appear before the state counsel, Barrister Tchokongoe said he was not aware but noted that all he knew was that the legal department had to interrogate Ben Muna.

When The Post met Ben Muna, he said the legal department has never served him a written or oral summons to appear in front of the state counsel for interrogation over Diboulé's death.

He said the purpose of every preliminary investigation is to get the people who were involved in a crime in one way or the other. He wondered why he has not been called up for interrogation if the legal department deemed it necessary; noting that his residence and work place is well known to some members of the Yaounde Legal Department.

Ben Muna said if Fru Ndi, whose residence is so many kilometers away from Yaounde was summoned for interrogation, what more of himself who stays and works in Yaounde. He said as the preliminary investigations are going on, he would readily meet officials of the legal department if they call him up for interrogation..

He mentioned one lawyer Mangwa who is posing as a defense lawyer of the civil party in the Diboulé case and suspected that some officials of the legal department might have gotten themselves entangled in the case and resorted to delaying justice by peddling rumours that border on his interrogation.

He noted that he would not be surprised if one lady whose name The Post got as Madam Nyah, and who was mentioned by some detainees for having sent them, is eventually called up for interrogation.

It should be recalled that the Fru Ndi's SDF filed a complaint to the legal department against Ben Muna for violating premises and organising an illegal meeting that led to the death of Diboulé. Observers thought that Ben Muna was going to be interrogated on this basis.

Ben Muna, who said, till date, his group has not received the order that banned his meeting, maintained that if he has to be taken to the court for organising an illegal meeting; it should be the state and not members of the Fru Ndi faction of the SDF.

Why wastes precious time claiming that you've not been summoned? A few months ago, you claimed that you weren't nofified of the banning of your May 26, 2006 gathering in Yaounde that led to the death of Diboule. You even claimed in an interview in Le Messager that it was thanks to the blood of Diboule that you people were able to hold your meeting. Again, you'd been warned not to parade yourself as 'President National du SDF' but you keep doing it. You jump from one illegal act to another and nothing happens to you?

The Yaounde regime is seemingly cosy with you today, but remember that this regime hasn't got friends. Mr. Titus Edzoa is a glaring example.

Continuous Adjournment of the case in the Mfoundi High Court is of no good to you and your cohorts. Your now despised and short-sighted ally, Mr. Ngwasiri asked the court to cancel the February 25, 2006 confirming his auto-exclusion from the SDF, has nothing to do with your claim that the court gave you people the SDF thru the infaumous ruling of April 24, 2006.

Though you've continued impersonate the SDF and her leadership, mid November is not far for the final Judgement (in Bamenda) will be read to your lawyers. Get yourself ready for exile! Today's generation and those to come will NEVER forgive you. I know your your comrade in illegality, Mr. Tabetsing Chretien is regretting that his idea of transferring the capital of the SDF from Bamenda to Yaounde had materialised, things would have worked this time aroud without much ado.

I look forward to the burial of your SDA (even though still to be born) just like SDP of Kamdoum, AFP of Maidadi, etc.

The noose is fast tightening around your neck.You are now just disorientated ,and desperate. Memebers of the Fru Ndi faction rightly took you to court for parading as SDF Chair,and the next onslaught on you will be for violating the premises of the party in Olezoa.The other part of organising an illegal convention has to be taken care of by the state.The same state that served you a ban ,and you spat on.If you have overcome your fear ,and shame ,and you are ready to let justice take its course, ok. But what is outrageously shameful in your behaviour is that, you say you are ready to be interrogated, but you tell the world today that your group did not receive the order that banned your convention.How can you get yourself ready for interrogation without committing a crime? When Chairman Fru Ndi was summoned for interrogation,he came out as a man ,and strong leader,and went through the grilling cool-headedly, but when Muna just gets air that there`s a summon that has been waiting for him, he starts making a review of all the lawyers,accusing them as posing as defence lawyers,and also accuse others of peddling rumours that border on his interrogation. So how many accusations and counter accusations are we going witness,just because Muna has to be interrogated? Chicken-hearted son of a former Prime Minister,You have not yet seen anything!

The day you will cross the threshold of the State Counsel`s Office for purposes of interrogation,at the end of the exercise ,just commit suicide.That will be the payback time for all the sufferings you`ve brought to innocent people. Affaire Diboule: Le procureur accuse Ben Muna

Le magistrat Lavoisier Kwangué Kwangué, le leader dissident du Sdf empêche la manifestation de la vérité.

L’information judiciaire sur l’affaire Grégoire Diboulé (le secrétaire à l’organisation du Social democratic Front – Sdf tendance Bernard Muna, sauvagement assassiné le 26 mai dernier au siège du parti à Olézoa) suit son cours. Après l’inculpation et l’audition d’une vingtaine de présumés assassins (actuellement en détention préventive à la prison centrale de Kondengui), le procureur Lavoisier Kwangué Kwangué a entendu deux fois (le 22 août et le 3 octobre 2006) le chairman Ni John Fru Ndi, accusé de complicité d’assassinat et blessures légères. Depuis lors, les enquêtes piétinent, la partie civile ayant catégoriquement refusé jusqu’ici de se présenter chez le procureur. Malgré les convocations verbales adressées via Me Mangoua. Qui est jusqu’ici constitué pour défendre ladite partie.
Au parquet, ce refus délibéré de se présenter chez le procureur est considéré comme une entrave à la justice. “ Bernard Muna n’est pas partie civile dans cette affaire. Il ne s’agit pas d’une affaire Fru Ndi contre Muna ou de parti politique. Il y a eu mort d’homme dans mon unité de commandement et je dois savoir qui sont les auteurs de ce forfait. Est partie civile toute personne ayant subi un préjudice. Les blessés ayant régulièrement déposé dans nos services des certificats médicaux et les membres de la famille naturelle de Diboulé constituent la partie civile. Nous ne comprenons pas pourquoi Muna empêche aux gens de contribuer à la manifestation de la vérité, alors que lui-même sait que c’est une faute ”, dénonce Lavoisier Kwangué Kwangué, le procureur près du parquet du tribunal de grande instance de Yaoundé-centre administratif. Il ajoute : “ Muna ne pourra être convoqué ici que pour répondre des accusations portées contre lui par Ni John Fru Ndi avec constitution de la partie civile, pour organisation d’une manifestation interdite”. C’est en principe après l’audition de la partie civile qu’une phase de la confrontation devrait être envisagée. Ceci en vue de faire la lumière sur certains points discordants.

Bernard Muna ne conteste pas avoir été invité à faire venir la partie civile au parquet. Il dit n’avoir jamais constitué Me Mangoua pour la défense de ses intérêts. “ C’est Me Mangoua qui m’a téléphoné m’informant qu’il faut que la partie civile se présente. Je lui ai demandé qui l’a constitué. Je pense que le procureur devrait lui demander qui lui a donné ce privilège de défendre la partie civile. Si le procureur a besoin de mon apport, il va m’écrire parce qu’il sait là où je suis ”, rétorque l’ancien bâtonnier. Scandalisé par cette attitude, Me Mangoua s’apprêterait d’ailleurs à abandonner ce dossier. “ La partie civile ne doit pas se faire prier pour se rendre au parquet puisque c’est elle qui demande que justice soit faite. Si jamais elle refuse définitivement de se présenter, le procureur peut faire un procès verbal de carence qui va compromettre le paiement des dommages et intérêts. Ils doivent le savoir. Je n’ai pas besoin de me faire constituer par quelqu’un. Il y a une disposition de la loi qui autorise à un avocat de se lever spontanément et de défendre un accusé qui est acculé. Cela s’appelle amicus curri, c’est-à-dire le secours d’ami ”, explique cet avocat rencontré hier dans son cabinet sis au premier étage de l’immeuble Shell à Yaoundé.

Mais, cette situation, apprend-on, ne peut pas compromettre l’évolution des enquêtes. “ Ceux qui ont l’impression que les enquêtes connaissent un ralentissement se trompent. L’enquête ne se limite pas seulement à l’audition de Fru Ndi. Il faut réunir tous les éléments pouvant contribuer à la manifestation de la vérité. Sinon nous risquerons d’envoyer un dossier vide au tribunal ”, rassure Lavoisier Kwangué Kwangué. Seulement, certaines indiscrétions révèlent que le procureur n’aurait pas les mains libres dans cette affaire. Bernard Muna, apprend-on, aurait réussi à convaincre son frère consanguin Yang Philémon, le secrétaire général adjoint de la présidence de la République, d’imposer la léthargie actuellement observée dans l’évolution de cette affaire. Les opérations se dérouleraient avec la bénédiction du secrétaire général du ministère de la justice Ngoa Messia, qui suivrait personnellement ce dossier.

Leadership au sein du SDF:Muna débouté à Bamenda

Le président du tribunal confirme sa décision d’interdire le titre de Chairman du Sdf au chef de la tendance dissidente.

L’atmosphère était tendue lundi dernier 30 octobre au Tribunal de grande instance de la Mezam où passait en audience la fameuse affaire opposant John Fru Ndi à Clement Ngwasiri et Bernard Achuo Muna au sujet de la direction du Sdf. Eclats de voix entre le Juge Jack Emile Ambo Ezie et le collège de la défense du duo Clement Ngwasiri et Bernard Muna, constitué de Mes Asongwe Peter, Amaazee Anthony, Bonu Innocent. Sans se plier en quatre, Me Bonu Innocent, suivi dans sa démarche par Me Amaazee Anthony, est catégorique : “ ce tribunal est un obstacle pour nous ”, priant le magistrat en charge de se dessaisir de cette affaire. Et de réitérer ce souhait par écrit au juge Jack Emile Ambo Ezie. Comme pour insinuer son parti pris. Le président du tribunal refuse d’accéder à cette demande des avocats de Bernard Muna et Ngwasiri Clement. Suffisant pour soulever la montée d’adrénaline. Même les dix (10) minutes de pose accordées autour de 13heures 30 minutes n’y font rien.

En effet, tout serait parti des préalables posés par les conseils de ces derniers. Qui voulaient que le juge considère leur défense avant l’entrée dans le fond du débat. Peine perdue pour eux, car le président du Tgi ne l’entendra pas de cette oreille et leur demande d’aller tout droit au but. A savoir produire les éléments de leur défense. On se souvient que le 26 Septembre dernier, ce même magistrat dans son jugement par contumace interdisait à l’ex-bâtonnier de continuer à “ parader et de se présenter sous le titre de président ou chairman du Sdf, comme il l’a fait jusqu’à présent, sans qualité. Si le défendeur, M. Muna ou n’importe lequel de leurs agents ou sympathisants persistait dans cette voie de l’illégalité, il serait passible d’outrage au tribunal et à l’administration ”. C’est à la suite de ce jugement rendu par contumace que les avocats de Ngwasiri Clement et Bernard Muna, avaient introduit une requête auprès du même juge, priant ce dernier de reconsidérer voire rabattre sa décision.

Pour eux, ce jugement a été obtenu de “ façon irrégulière ” et à la limite de “ manière frauduleuse ”, a évoqué Me Bonu. C’est “ commettre de l’injustice que d’entendre une seule partie ”, explique Me Bonu. Par cet acte, poursuit-il, “ la justice a été rendue avant que les personnes incriminées ne soient entendues ”. Me Amaazee n’en dit pas moins : “ en tant que conseil de Ngwasiri, je n’ai pas été servi et aucun effort n’a été fait dans ce sens m’invitant ou mon client à se présenter au Tgi ce jour-là (26 septembre 2006 ndlr) ”. A l’occasion, ils évoquent une procédure quasi - similaire pendante devant le Tgi du Mfoundi. Ce qui a fait dire au juge d’intance Jack Emile Ambo Ezie de la Mezam que si un “ individu commet plusieurs crimes différents, doit-on attendre qu’il soit jugé par un tribunal avant que l’autre engage sa procédure? ”.

Le camp Fru Ndi

Me Joseph Mbah Ndam, venu à la rescousse, a puisé dans le droit privé international pour “ prouver ” la compétence du Tgi de la Mezam à connaître de cette affaire “ le siège naturel du Sdf est à Bamenda, son chairman Fru Ndi est domicilié à Bamenda et selon le principe du Forum de convenance le tribunal de la Mezam est territorialement compétent à connaître de ce problème ”. Ce parlementaire de Batibo ira plus loin évoquant les statuts originels de création du Sdf qui sont en anglais; c’est sur la base de cette version et non celle en français sur laquelle s’agrippe Ngwasiri Clement “ professeur de droit privé anglosaxone (sic Me Mbah Ndam) ” qui serait utilisé lorsqu’il faudrait l’interpréter.

Pour sa part, Me Sama Francis a demandé au juge Jack Emile Ambo de sanctionner Bernard Muna “ pour outrage au tribunal et à l’administration ”. La raison fondamentale, l’avocat de Fru Ndi la puise dans la persistance de Bernard Muna à l’usurpation dans l’illégalité du titre de chairman ou président du Sdf, malgré le jugement du 26 septembre dernier l’y interdisant.

C’est le cas avec la récente réunion de la faction Muna tenue à Douala. Bien plus, poursuit Me Sama, le fils de l’ex-président de l’Assemblée nationale a écrit une lettre au gouverneur du Nord-ouest se présentant comme président du Sdf. Le délibéré de l’affaire aura lieu le 17 novembre prochain.
